Moje Školka

Terms and conditions

Effective from: 25. 8. 2026

These terms and conditions govern the mutual rights and obligations between the operator of the Moje Školka platform and the customer (the operator of a nursery, children's group, or similar facility) using the Moje Školka service.

1. Service Provider

The operator of the Moje Školka platform is Jitka Hořavová, Company ID No.: 88201856, VAT ID No.: CZ9059046150, with its registered office at Jiráskova 436/8, 789 85 Mohelnice, Czech Republic (hereinafter referred to as the “Provider”).

2. Scope of the Service

Moje Školka is a SaaS platform providing a public website, content administration, a parent portal, and related modules (news, galleries, documents, meal plans, contacts) for operators of kindergartens and childcare groups.

The scope and availability of individual features may vary depending on the selected plan.

3. Establishment of the Contractual Relationship

The contractual relationship is established by setting up a facility (kindergarten) on the platform based on the Customer’s order and its confirmation by the Provider, or by signing a separate agreement, where applicable.

4. Pricing and Payment Terms

The price of the Service and the applicable payment terms are governed by the current price list or by an individual agreement concluded between the Provider and the Customer.

Invoices are issued using the billing details provided by the Customer and are payable within the due date specified on the invoice.

5. Rights and Obligations of the Customer

• The Customer is responsible for all content published through the platform, including texts, photographs, and documents.

• The Customer is responsible for ensuring that it has obtained all necessary consents or other appropriate legal grounds for publishing photographs and personal data of children and employees, including any required consent from their legal representatives.

• The Customer must protect its administration login credentials and must not disclose them to unauthorized persons.

6. Rights and Obligations of the Provider

• The Provider makes reasonable efforts to ensure the availability of the Service but does not guarantee uninterrupted availability, for example due to maintenance, updates, or circumstances beyond the Provider’s reasonable control.

• The Provider processes personal data in accordance with the principles described in the Privacy Policy.

7. Liability

The Provider shall not be liable for damages arising from improper use of the platform, internet connection failures on the Customer’s side, or interference by a third party that could not reasonably have been prevented.

8. Term and Termination

The contractual relationship may be concluded for a fixed or indefinite period, depending on the specific agreement or order.

It may be terminated by mutual agreement of the parties or by notice under the conditions agreed between the Customer and the Provider.

9. Final Provisions

These Terms and Conditions are governed by the laws of the Czech Republic.

The Provider is entitled to amend these Terms and Conditions to a reasonable extent. Customers will be informed of any changes sufficiently in advance.
